Pre-Foreclosures Information (Lis Pendens)

Lis pendens is Latin for “pending notice”. The foreclosing attorney files a lis pendens against the property at the very beginning of the foreclosure process. It is the earliest point in the process that you can become aware of a potential foreclosure. From this point, a foreclosure sale can occur in as little as three month or as long as several years. Lis Pendens is one of the beginning steps in the foreclosure process, but the loan is probably already 60 days or more delinquent. The earlier you can get involved in the process the more likely you are to put a transaction together.

The information provided in the lis pendens category is basically the same as the foreclosure category with the exception of:

Original amount and date of the mortgage - The original amount of the mortgage placed against the property and the date the mortgage was completed.

Current principal balance of the mortgage - The principal amount of the mortgage on the date the lis pendens is filed. May or may not include additional fees or costs due.

As with the foreclosure information, we also provide case number, name of debtor, property address named in lis pendens, lender information, the estimated property value, gross equity, secondary lien holder information (if any), assessed value, property taxes due, foreclosing law firm information.
